These Terms & Conditions apply to Sedona Estate Pty Lt referred to as  ‘we’ or ‘us’ (ABN 70 395 980 034).

As a viticultural business, we must protect our vineyard, land and assets from diseases and damage to continue operating in a safe and healthy environment. We put the trust in our house guests to treat the Vineyard House and our property with respect. Nevertheless, we are required to state detailed Terms & Conditions in case of non-compliance. Please read these Terms & Conditions carefully.

By making a booking for a short-term stay at the Vineyard House, you and all house guests agree to abide by and comply with these Terms & Conditions on our website (last update on 5th of February 2024). For more information, view the Australian Consumer Law website consumerlaw.gov.au

1. INFORMATION ABOUT THE PROPERTY

1.1 ACCURACY We endeavour to ensure the information about the property is current and accurate on our website. All photos are taken onsite and are provided as an accurate representation of the Vineyard House and its surrounding area. Features and furnishings may change over time.

1.2 PROPERTY Our property is a working vineyard and winery with a cellar door that is open as specified on our website. There are times, for example vintage from March to April, when the activity levels and noise levels in the vineyard and winery are greater than normal.  Where possible, we endeavour to state high activity vineyard/winery/cellar door times on our website. The busy harvest time offers a special experience but cannot be guaranteed. When booking the Vineyard House, the use of the property is restricted to the Vineyard House and its garden. Due to the risk of spreading disease and for your safety, we cannot permit the access to the vineyards, winery and dams. The cellar door area is accessible for our house guests during the stated opening hours and for special events. Please familiarise yourself with the map in the house. Tandem parking for 2 cars is available at the house.

1.3 FACILITIES Our property is in a rural area, which requires environmental care when using facilities. The house is serviced by filtered rain tank water, a septic system, solar panels and energy-storage by a Tesla battery. Water and energy are precious. We have prepared some guidance on good use of solar generated energy. Please do not throw any foreign objects down the toilet. Small bins are provided in both bathrooms. If you require any assistance using appliances, please ask us for help. If anything is not in working order, we endeavour to replace it or repair it during your stay, if possible.

2. GENERAL RULES FOR OUR GUESTS

In line with the Local Laws, Murrindindi Shire Council, we endeavour to protect and enhance the amenity and environment of the region and enjoyment of our property.

2.1 HOUSE GUESTS The Vineyard House is a retreat accommodation for 1 – 4 guests aged 21 years and older. Photo identification may be requested prior and at arrival. The property is not suitable for children and pets. Visitors are not allowed.

2.2 ARRIVAL The Vineyard House has a serviced check-in until 7pm unless other arrangements are made.

2.3 NOISE AND AMENITY We expect that our house guests contain noise at a reasonable level and respect the amenity of the neighbourhood. Like in residential areas, unreasonable noise is not permitted between 10pm and 7am. The Local Laws do not permit the use of motorised recreational vehicles on private or Council land.

2.4 GARBAGE A general waste bin is provided in the kitchen. A bin for items to be recycled such as plastic, glass bottles, paper etc. is provided in the entrance room (mud room). Each bathroom has a small waste bin. Emptying of the rubbish bins at the end of your stay is part of our general cleaning service. However, if the bins require emptying during your stay, please use the Council rubbish bins near the cellar door or ask us for assistance.

2.5 SAFETY AND SECURITY We expect our guests to maintain the security of the Vineyard House and premise. The entrance gates to the property can stay open while residing at the property or going out. We have installed several security cameras and plenty of outdoor lighting. Garden lights and some outdoor lights can be operated from the living room and the King room. There are also sensor lights near the winery and cellar door that may be triggered by wildlife during the night.

2.6 ALCOHOL AND FOOD We expect our guests to consume alcohol responsibly and comply with the Victorian Liquor Law. Sedona Estate Pty Ld. has a registered Producer’s License and holds a Food Premise Registration. We can supply Sedona Estate wines and our artisan platters to guests staying at the Vineyard House.

2.7 WILDLIFE AND DAM We are fortunate to enjoy a wide range of wildlife on our property. Kangaroos can often be seen in the early morning hours and at dusk. There are many nocturnal animals that might be heard from the Vineyard House. The nearby dam is home to many Australian frogs and turtles. Victoria is also home to poisonous snakes, which are active in the warmer months of the year. Always, enjoy wildlife from a safe distance. Stay away from the dam, do not jump of the deck in the garden or walk around the shrubby parts around the house or in high grass. Be observant and watch the wildlife from a safe distance.

2.8 SMOKING AND OPEN FIRES The house is strictly non-smoking and non-vaping. Like most of Victoria, we are in a bushfire-prone area. Outdoor fires are not permitted during the bushfire season. A gas-operated barbecue is provided outside.

2.9 PARTIES AND VISITORS Parties and visitors are not permitted. The guest house is a retreat for peaceful enjoyment. Our property is also not suitable for wedding preparations and entourage for offsite weddings.

2.10 ENERGY STORAGE We have installed a Tesla battery in the secured entrance area to the King room. Please respect the warning signs and DO NOT touch/move the switch or any other buttons on the Tesla battery. More information is available in the house.

2.11 DEPARTURE Please leave the house and premise in good and tidy conditions. Close all windows and doors. Turn off electrical appliances and lights. Place used crockery and cutlery in the dishwasher and clean the barbecue, if used.

2.12 DAMAGE Accidental breakage of items in the Vineyard House can happen. Please let us know as soon as possible. We will assess the damage in a fair manner; significant damage or repairs or loss of items have to be paid for by the guests. Any intentional damage to the house, property and items belonging to us or theft will be reported to the police and handled in accordance with the law.

2.13 CLEANING FEES The general cleaning fee is included in the booking rates. An additional cleaning fee of $40 applies to cleaning the barbecue, if required. If the house is left untidy and dirty as a result of your occupancy and requires excessive cleaning, a special cleaning fee will be charged (see 3.3).

2.14 LOSS, THEFT, INJURY Sedona Estate and the owner of the property are not responsible for the loss or theft of our guests’ personal property or for any bodily injury that occurs on or at the property. We recommend guests purchase travel insurance for injuries, illness, accidents, or loss of property.

2.15 EVICTION In the case of a serious breach of the Terms & Conditions as determined by us, an immediate eviction will apply. This may also result in the loss of your bond (if any) and /or monies paid (or owed) by you. Any additional charges that may apply as per 3.3 of our Terms & Conditions.

3. BOOKING INFORMATION

3.1 PAYMENT OPTIONS We accept online payments using the service provider Stripe. Acceptable credit cards are MasterCard, Visa, American Express and more. Debit cards are also accepted. Your credit or debit card details are encrypted by Stripe and will only be used for the purpose of the booking.

3.2 CANCELLATION POLICY In the case of a cancellation of a booking by our guests or us due to events beyond all parties’ control such as bushfires, flooding, access road closure, damage to the property or Vineyard House, both parties are released from the contract (see consumerlaw.gov.au). If you need to cancel your booking, please notify us in writing. The following cancellation policy applies:

3.2.1 To receive a full refund, guests must cancel at least 30 days before check-in.

3.2.2 If guests cancel between 7 and 30 days before check-in, we will refund 50% for all nights and services booked.

3.2.3 If guests cancel less than 7 days before check-in, no refund will be provided.

3.2.4 Guests can also receive a full refund if they cancel within 48 hours of booking, if the cancellation occurs at least 14 days before check-in.

Bad weather conditions or less than ideal weather that may affect your stay such as, but not limited to, foggy Winter Days, cloudy sunsets or rain and unexpected illness or change of circumstances/mind are not an entitlement for a refund. We recommend that you take out travel insurance to protect you for these events.  No refund will be given for early departure. Any refund will be processed by Stripe and credited to your credit card or debit card used for the payment of the booking. Refund fees charged by Stripe will be automatically deducted.

3.4 TRANSFER Bookings may be transferred to a future date by the guest, if the cancellation occurs at least 14 days prior to the arrival date. The booking transfer is applicable for 6 months from the original arrival date. In case of a nightly rate increase, the difference must be paid by the guests. Repeated changes to the bookings will incur an administration fee of $50.00.

3.5 CREDIT CARD BOND At check-in we require a copy of your credit card or debit card. The information will be kept securely and destroyed after your departure. Your credit card or debit card will only be charged in the case of breaching the Terms & Conditions. Our guests will be notified of breakage, damage, repair, or additional cleaning fees that will be charged to their credit card or debit card.

4. INTERPRETATION AND INDEMNITY

4.1 DEFINITION Website means the information portal at sedonaestate.com.au. Sedona Estate refers to Sedona Estate Pty Ltd. (ABN 70 395 980 034). Owner refers to the owner of the property. The Vineyard House is the short-term accommodation at Sedona Estate. Total Booking Fee means the total rate or amount payable for your stay including the Credit or Debit Card processing fees. Guest means any person residing overnight at the Vineyard House and permitted under the same booking. Prices are in Australian Dollars and GST inclusive.

4.2 INDEMNITY CLAUSE All guests agree to indemnify and hold Sedona Estate Pty Ltd and the property owner harmless from any liability for personal injury or property damage sustained by guest(s).
